Switzerland implements EU drone regulations

From January 1, 2023, remote pilots will be subject to new rules in Switzerland, according to the Federal Council’s decision.

On November 24, 2022, the Joint Committee of the Bilateral Air Transport Agreement between Switzerland and the European Union ratified Switzerland’s adoption of the EU’s regulations on drones, as well as various EU acts.

The introduction of such a harmonized legal framework with Europe represents a real advantage for the Swiss drone industry: it will benefit from fixed regulations on safety standards for the manufacture, certification and operation of drones.

In addition, the new law will impose new maximum flight heights, weight limits and geographical restrictions.

For private customers, drones weighing ≥250 g to 25 kg (model aircraft to 30 kg) require, under Swiss law, compulsory third-party liability insurance with an insured sum of at least CHF 1 million. This cover must be included in the “Pilots and users of drones and/or model aircraft” private liability policy, at an additional premium.

Existing customers who have this cover in their liability insurance policies need do nothing, and are therefore covered.

Drones weighing less than 250 g are covered by basic private liability insurance.

For customers using drones for professional purposes, drones weighing ≥250 g to 25 kg (model aircraft to 30 kg) require, under Swiss law, compulsory third-party liability insurance with an insured sum of at least CHF 1 million. This cover is only available if customers have taken out additional “Pilots and users of drones and model aircraft” cover, at an additional premium. Existing customers with this supplementary cover are therefore covered. We will also be informing them shortly.

Drones weighing less than 250 g are covered by the company’s basic civil liability insurance.
