A cantonal court instructed an unemployment insurance fund to recalculate short-time working compensation, taking into account vacation and public holiday compensation.
If this ruling goes into effect, or is upheld by the Federal Court, it would mean an increase in RHT compensation for companies of around 13%.
To preserve their rights, companies benefiting from the Covid RHT since March 2020 must apply to their unemployment fund for a reassessment of their benefits.
In the absence of a Seco directive providing for automatic reassessment to date, we advise companies to immediately send their unemployment fund this letter (Word file) prepared by the Swiss Employers’ Association.
A request for reassessment of an administrative decision must be submitted within one year, i.e. by March 31 at the latest for benefits granted in March 2020.
